All individuals or entities (hereinafter, the "User") using the Service must fully understand and agree to the content of these Terms before using the Service.
Article 1 (Scope of Application)
- These Terms shall apply to the relationship between the Company and the User (hereinafter, the "User") regarding the Service.
- These Terms stipulate the conditions of use and the rights and obligations of the parties related to the Service.
Article 2 (Agreement to Terms and Formation of Contract)
- Agreement to these Terms is required for the use of the Service.
- The User shall be deemed to have agreed to these Terms at the time an account is opened to commence use of the Service.
Article 3 (Modification of Terms)
- These Terms may be updated from time to time as necessary. The Company will use its best efforts to notify the User of material changes but does not guarantee such notification.
- Continued use of the Service after any modification of the Terms shall constitute acceptance of the updated Terms.
- If the User does not agree to the modification of the Terms, the User may terminate their account.
Article 4 (Handling of Data)
- The copyright to all videos and content created using the Service shall belong to the User; however, the Company shall have the right to utilize them to the extent necessary for the provision of the Service.
- The Company may request the User to edit or delete content to ensure the proper use of the Service.
- The Company provides access to a music library and media templates for video production. These materials may be used freely on external platforms such as Instagram, TikTok, and YouTube. However, the legal responsibility for appropriate use rests with the User and their brand.
- The Company shall not be liable for any user-generated content.
- The Company provides analytics tools to track video performance. All data is restricted to the User's use only and shall be treated as confidential. The Company will not use or share this data externally.
Article 5 (Fees, Refunds, and Cancellation Policy)
- The fee structure for the Service consists of multiple plans, each including different features and services.
- For details on the plans and available features, please check the official website for the latest information.
- The User may cancel their use of the Service at any time, but no refunds will be issued.
- After cancellation of the Service, the User's access to the Service will be retained until the end of the current billing cycle.
Article 6 (Eligibility for Use)
- The User may not use the Service if they are prohibited from receiving the Service by applicable laws in their country of residence.
- Use by individuals under the age of 18 is not permitted.
- The User must be a human being, and the use of automated accounts is not permitted.
- It is not permitted to use the Service for any unlawful or improper purpose.
Article 7 (Handling of External Integration Data)
- The Company may integrate with third-party platforms such as TikTok, Instagram, and YouTube.
- By using the Service, the User agrees in advance to comply with the terms and policies of these third-party platforms.
- The Company shall not be responsible for any issues related to these third-party platforms.
Article 8 (Prohibited Matters)
- In addition to other prohibitions set forth in these Terms, the User is prohibited from the following uses regarding the Company's website or its content: (a) Using it for any unlawful purpose. (b) Soliciting others to perform or participate in any unlawful acts. (c) Violating any international, regional, or any other laws, ordinances, or regulatory norms. (d) Any act that infringes or may infringe on the intellectual property rights, property rights, privacy rights, portrait rights, or other rights of the Company, the User, other users of the Service, or third parties. (e) Harassing, abusing, insulting, harming, defaming, slandering, intimidating, or discriminating based on gender, sexual orientation, religion, ethnicity, race, age, national origin, or disability. (f) Submitting false or misleading information. (g) Acts intended to copy the reverse engineering, reverse compilation, reverse assembly, or other related technology performed in relation to the Service. Or uploading or transmitting viruses or other types of malicious code that may be used. (h) Illegally acquiring or using external service authentication information (such as API keys) for the purpose of integration with the Service. (i) Collecting or tracking the personal information of others. (j) Engaging in spam, phishing, pharming, fraudulent activities, spidering, crawling, or scraping. (k) Using it for any obscene or immoral purpose. (l) Interfering with or circumventing the security features of the Service, related websites, other websites, or the Internet. (m) Any other act that is likely to cause disadvantage to the Company or adversely affect the Service.
- If the User violates any of the prohibited uses, the Company reserves the right to impose restrictions on the User's use of the Service without prior notice.
Article 9 (Acquisition of Personal Information, etc.)
- The User agrees to provide the Company with the following personal information and related data:
- Personal information such as (but not limited to) name, address, telephone number, email address, and ID on e-commerce sites.
- Order information and other related data on e-commerce sites.
- The Company shall handle the personal information of the User provided under the preceding paragraph appropriately in accordance with the Company's separately established Privacy Policy.
- The User must check the Company's Privacy Policy and agree to its content before using the Service.
Article 10 (Interruption and Suspension)
- The Company may temporarily interrupt or suspend the Service in the following cases:
- System maintenance or response to a failure.
- Force majeure events such as natural disasters.
- Other cases where the Company deems it necessary.
- The Company shall not be liable for any damages incurred by the User due to the interruption or suspension.
Article 11 (Change of Service Content)
The Company may change or terminate the content of the Service by notifying the User.
Article 12 (Suspension of Use and Contract Termination)
- The Company reserves the right to terminate the contract and close the account without prior notice in the event of non-payment of fees, violation of the Terms, or unauthorized use of the Service.
- The Company shall not be liable for any damages resulting from contract termination.
Article 13 (Exclusion of Anti-Social Forces)
- The Company and the User mutually represent and warrant that they, their officers, or employees do not currently and will not in the future fall under the category of, nor utilize, organized crime groups, companies associated with organized crime groups, corporate racketeers, groups pretending to engage in social movements, or others equivalent thereto (hereinafter, "Anti-Social Forces").
- The Company and the User may immediately terminate this contract without any notice if it is found that the other party falls under the category of Anti-Social Forces or is deemed to have utilized Anti-Social Forces.
- A party whose contract has been terminated pursuant to the preceding paragraph shall not be entitled to claim any damages resulting from the termination.
Article 14 (Limitation of Liability)
- The Company shall not be liable for damages directly or indirectly arising from the use of the Service, unless caused by the Company's willful misconduct or gross negligence.
- The User shall use the Service at their own risk.
Article 15 (Disclaimer)
- The Service is provided "as is," and the Company does not guarantee its suitability for a particular purpose or its completeness.
- The Company shall not be liable for damages caused by technical problems or the actions of third parties.
Article 16 (Governing Law)
These Terms shall be governed by the laws of India.
Article 17 (Jurisdiction)
Any disputes related to these Terms shall be handled by arbitration in accordance with industry standards, and the applicable court of jurisdiction will depend on the User's location.
